Setter Freelancing Program Subscription Agreement

This Freelancing Program Agreement (“Agreement”) is made effective as of product purchase date (“Effective Date”), by and between Spartan Setters Academy, an entity organized and existing under the laws of Philippines, and the purchaser (“Subscriber”).

Recitals

WHEREAS, the Company specializes in providing comprehensive digital marketing training through its Setter Freelancing Program (“Program”);

WHEREAS, the Subscriber wishes to enroll in the Program to enhance their digital marketing skills and capabilities;

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:

1. Subscription and Term

1.1 Subscription: The Subscriber hereby agrees to subscribe to the Setter Freelancing Program provided by the Company.

1.2 Term: The term of this Agreement shall commence on the Effective Date and shall continue for a period of one (1) year (“Subscription Term”), unless earlier terminated in accordance with the provisions of this Agreement.

2. Subscription Fee

2.1 Fee: The Subscriber agrees to pay the Company a subscription fee of Eight Thousand Nine Hundred Ninety Philippine Pesos (₱8,990.00) for the one-year access to the Program.

2.2 Payment: The subscription fee is due in full upon execution of this Agreement.

3. Program Services

3.1 The Program includes

• 2-Week Setter Live Program (Basic and Advanced)
• Access to Previous Recording for the next 12 months
• Access to Scripts, videos and Strategies for Setting
• Coaching Sessions with Spartan Setter Team
• OJT Program from Setter Partners
• Technical and Client Support after the training for 12 months

3.2 The Company will provide these services starting from the Effective Date and will ensure access for the duration of the Subscription Term.

4. Refund and Cancellation Policy

4.1 Refund Eligibility: Refunds are available within 60 days of the Effective Date, provided the Program has not commenced with reasonable requests not included below. If the Subscriber participates in any session, they forfeit their right to a refund.

4.2 Non-refundable Circumstances: Refunds will not be granted for changes of mind, personal emergencies, failure to engage in pre- or during-Program activities, or for partial payments.

4.3 Money Back Action Guarantee: This is distinct from the refund policy and is applicable post-Program completion, provided the Subscriber can demonstrate application and unsuccessful outcome of Program strategies, even after personalized consultation and mentoring.

4.3.1 Eligibility Criteria for Money Back Guarantee:

4.3.1.1 Full Engagement Requirement: The Money Back Guarantee is applicable only after the subscriber has fully engaged with the program. Full engagement is defined as the completion of all modules, activities, and assignments as outlined in the program curriculum.

4.3.1.2 Application of Strategies: The subscriber must demonstrate that they have applied all strategies taught within the program. This includes, but is not limited to, the execution of techniques, methods, and processes as instructed during the course of the program.

4.3.1.3 One-on-One Coaching/Consultation: In addition to applying the strategies, the subscriber must have participated in a one-on-one coaching or consultation call. This call is aimed at providing personalized advice, adjustments, and mentorship to ensure the effective application of the program strategies.

4.3.1.4 Proof of Unsuccessful Outcome: Despite fulfilling the above conditions, if the subscriber can provide evidence that the strategies, even when correctly applied and supplemented with our personalized consultation, did not lead to a successful outcome, they are eligible for the Money Back Guarantee.

4.3.2 Money Back Guarantee Compensation:

Upon meeting all the aforementioned criteria and demonstrating an unsuccessful outcome despite diligent application and consultation, we will honor our Money Back Guarantee. This guarantee includes a full refund of the program fee paid by the subscriber, plus an additional compensation of Php 3,000.

4.3.3 Exclusions:

Please note that the Money Back Guarantee does NOT apply to partial payments. The guarantee is only valid for subscribers who have paid the program fee in full and have adhered to all program participation requirements as stated.

5. Confidentiality

5.1 Both parties agree to maintain the confidentiality of the terms of this Agreement, the Program’s content, and any proprietary information exchanged during the Subscription Term.

6. Governing Law and Dispute Resolution

6.1 This Agreement shall be governed by and construed in accordance with the laws of [Insert Jurisdiction Here]. Any disputes arising under or related to this Agreement shall be resolved through mediation, followed by binding arbitration, if necessary.

7. Miscellaneous

7.1 Entire Agreement: This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements and understandings, both written and oral.

7.2 Amendment: This Agreement may only be amended or modified by a written document executed by both parties.
